Legal Question in Real Estate Law in India
Sir, I have purchased a built house near a railway track. I have obtained survey sketch, approved building plan from local authorities (city municipality & urban development authority) and also no objection certificate from railway authorities. However, I have heard that railway authorities and civic authorities are planning to build an overbridge as traffic is very heavy.
In this backdrop, I may have to give up my land+constructed house for the project. Now whether am i entitled to get compensation at market rates or land acqusition rates of govt. I have taken a loan from Nationalised Bank and am i able to get compensation at least for the loan amount outstanding. Please reply

Land acquisitions are normally made at market rates.
In case you are not satisfied with rates offered for acquisition, you can approach court for enhanced compensation.
