Legal Question in Real Estate Law in India

Sir,

I am doing business (trading) in my wife name as well as in my name, but now i have to prove that business run by me in my wifes name is benami, so that property purchased out of income of her business could prove benami.

At present I have collected following evidence, is it sufficient to prove benami in civil court :

- All emails sent to vendors & customers by me for marketing.

- All email recd. by me from vendors & customers for business related matters/orders etc

- No email sent by my wife to any customer.

- My mobile bills showing all calls made by me to customers.

- Mobile bill of my wife where there is no business calls

- My 8-10 yr work experience in the same field for doing this business, while she has no

experience of doing business.

this can not be considered benami as in the eyes of law, husband and wife are single entity. you cannot evade your legal liabilities under the garb of benami business.
