I received reply from Mr. Nahar (Adv.) for the below gievn query. Thank you very much for the quick reply.
I lodged a complaint with Nagpur Municipal Corporation and they gave the notice to him and now he has destroyed the wall. But he has now created another problem. He is not allowing me to park my and my families vehicles in front parking area as he has parked few cars of his relatives in such a way that their is no space left. I requested him again on this but he is vey adamant. Please guide me waht can be done on this. Is there any act or section on this in our law. Is so please guide me.

Sir, I have purchased a flat on 2nd floor in a scheme with only four flats. Two flats ate 1st floor are with the two owners who constructed it. In my sale deed it is mentioned that "I will not encroach the vacant land in the ground floor and if in future FSI is increased, I will not have the right to claim the share in contsruction. I will have common share in parking at the ground floor and all other amenities in the building".
Now one of the coowner has occupied the front area in the building (around 400 sq. ft) by consructing the two rows of bricks. Due to this, we are not able to park our cars. Does he has any right to do this. If not, what can we do on this. Can we sent the legal notice to him?
Please reply me as early as possible.

File your application again with a request that he has encoach your space for parking and the same may be marked for you only as per sale deed.
You may make an appropriate complaint to the local authorities as also the local police.
