Legal Question in Real Estate Law in India

Hello Sir/Madam,

I am Subhajit from Kolkata, West Bengal. Our neighbor planted a coconut tree at the back side of her property, ten years back. Now the coconut tree has bent over our thatch made house. The said coconut tree is damaging our poor house made of bamboo. All the leaves of the coconut tree is over our house. Now and then coconuts,dry flowers are falling on our house. We have informed her about the said damages and problems created by the said tree planted by herself, but she never showed any importance to our problems; rather she quarrels with us. We have lodged a complaint to the local authority but she has not listened to the respective authority. The tree is disrupting our life by making damages to our property and at any point of time it can harm us by coconuts falling from the same.

What can we do now? Is there any legal steps to proceed for the removal of the tree from it's root(cutting)?

Can we lodge a complaint to the local Police station? Will it work?

Is there any prohibition of act to prevent the cutting of the said coconut tree? Where can we move to get the perfect solution for this unwanted problem.

Please help me to get the perfect and faster solution for the said.

initially complaint to local police station

if still does'nt work.....than u can file civil suit on the basis of common law

Consider reporting the matter to police. Followed by a Notice to the land lady and local authority. Followed by a suit under law of Torts against the land lady and local authority.
