Legal Question in Real Estate Law in India
Sir,
My father owns our house. We and our grand parents used to live in here since 25 yrs. One of the three uncles was allowed to stay with us by our grand parents. Now both our grand parents are dead and this uncle wants his share in the property and he also is causing hurdles in any renovation works being carried out in our house.Plz help sir what to do?

If your father is the owner of the property then your father can file a suit for possession against your uncle (s) and if your father can prove that your uncle was and is a LICENSEE then your father can file a suit for Mandatory Injunction against your uncle (s).

If a property is self acquired and owned by an individual, then others will not have any share or right in such property.
