Legal Question in Real Estate Law in India
Hello sir,My father purchase a land some 30 years ago and the land is still under his possession.at the time of purchasing this land he has added my grandfather name,but there is no signature of my grandfather (only name) on sale deed but the payment was done by father only,(no proof of payrment)now my grand father is no more.we also has a will written in my father name but it is unregisterd.both my father and grandfather name is there on 7/12 extract,the probelm we are facing is i have 4 uncle,2 aunt and grandmother who all are claiming 50 % ownership of this plot,how can i withdraw name of my grandfather from 7/12 extract or is there any other way of making my father 100% owner of this plot.please suggest.Thamks

As you mentioned that ur grandfather name is there in the sale deed he automatically becomes the owner of 50 % of the said land ...
and whats there in will need to go through.... its not necessary to get the will registered...

Signature of purchaser was not necessary on sale deed in past - prior to 2000-2001 i.e. before amendment and commencement of photograph etc. of all the parties.
Share of grandfather will be governed by law of succession governing him.
