Legal Question in Real Estate Law in India

Sir,

We want to buy property in Dadar.However, owner(father) is dead without nomination or will. There are 3 sons& 1 daughter.

1. My question is how these can be sorted out legally.

2.On agreement it is mentioned that ownership in freehold. However, chairman is saying it has not been mentioned on 7/12 survey and property card can not be found.The building is 7 storied and 32 years old.OC for only four floors. Our property in on 4th floor.

Is it safe to go for this deal?

Your question needs to be bifurcated in two parts to answer.

Firstly - The demise of original owner. - In this event - ideally a probate is requried.

Secondly - Issues of Free Hold and OC. - For these issues one needs to see the documents.
