Legal Question in Real Estate Law in India

Sir,

We have properties in name of our Grand father. The property is self earned property of my grandfather. Firstly my grandmother expired and than grand father. We are in little worry as my father is not happy with us and he wants to marry third time. He has lost lot of money for same. We are worried that he will sell off the property putting us homeless. We were safe till grandfather was alive. We all live and own all the property jointly. There is no will.

I want to know following:

1. Can my father sell off the property eventhough we are in joint possession.

2. Is there any law to prevent ourself so that we stay together without loosing anybodies interest.

The answer to your queries are follows:-

1) Yes your father can sell the property as being the legal heir of your grand father. Possession has nothing to do with the ownership.

2)Yes there is way in which you can stop him .
