Legal Question in Real Estate Law in India
Can a Sister claim share for acestorial or fathers property
Hi
Me and My Wife have been living for past 4 years on the ground floor of My father-in-law property which comprises of gr + first floor and a terrace. This property was inherited by My wifes mother which was then only a cottage on decision to build the same 4 years back the brother and my wife his sister put in equal amount of money to build the same on a mutal agreement that the top floor would be his and the ground floor would belong to my wife ,The money was paid in cash which was a mistake we realized later. After my mother in law expired my father in law claimed the property without the concern of the children who were then aged 15 and 13 respectively , Now when we are requesting for a will to be made , her brother hits back by saying a will has already been made and makes him the only owner to his fathers property, we are worried as we will be left homeless if the brother sells the place , kindly advice

The facts stated by you are not very clear.
However, generally speaking, yes, the sister may claim her share, in the ancestral property, and especially to her mother's property.
