Legal Question in Real Estate Law in India
There are so many so-called "gated communities" in Bangalore. Why has nothing been done about them? We are residing in a campus surrounded by compound wall. There is only one entry & exit. While purchasing the house in the year 2004. Now after 5 years the builder has acquired an adjacent land for development & trying to give access from the existing closed boundary wall. This was not revealed to us while purchasing the house 5 years back. Is there any legal binding on the builder to refrain him from opening the compound wall? Though the adjacent area under development has very wide opening on the other side. Please guide me.

If there is no right of way reserved by the builder in the agreement or conveyance, then he has no authority to use land sold to you for access.
