Legal Question in Real Estate Law in India

Ours is a Society in South Mumbai. A member of our Society wants to see the minutes of the General Body meetings and the Managing Committee meetings for the last 40 years. Since he lives in Kolkata he has authorized a lawyer to take inspection.

The Society wants to give inspection only to the member as bye law 23 makes no provision for giving inspection to any one other than the member.

Is the Society correct in insisting that the member be present at the time of inspection of the documents?

You need to go through your entire bye-laws to find out whether a member can authorised a person for doing certain things and then decide further recourse.
