Legal Question in Real Estate Law in India
My son is not living with me.I am in possession of the house regd. in the name of my said son.My said son is only a benami-holder on my behalf as the entire sales consideration has been paid by me from my bank-account.
Can it be said that my said son is in possession of the property notwithstanding the fact that I am in possession of the same & my son is not living therein? Give a detailed reply.

Possession of the house does not make you the owner . According to the present law your son is the owner of the house despite the consideration has been paid by you.
