Legal Question in Real Estate Law in India
We four sons and three sisters with my mother have decided to partition my mother self acquired property and my deceased father self acquired property. My mother has settled her property to her four sons and we four sons and my mother released my father property to my sisters. The settlements by mother and release deeds by sons are separately executed and registered (Totally four settlement deeds and five release deeds). Now we came to know that the properties released to our sisters are under litigation and hence they force us to come forward for partition again with the intension to claim the equal share. They also try to convince my mother in this regard. We the four sons not accept their idea. My doubt is
1) Is it possible to them to apply for partition legally along with my mother?
2) Can my mother cancel her settlement deed already executed and registered in favour of sons?
3) What steps can we take to handle this problem?
