Legal Question in Real Estate Law in India
If the SRO gives a nil encumbrance certificate regarding a land bearing a specific survey number, and based on that nil EC, if a citizen buys that land and if it is later found that the vendor did not have the right to alienate the title to that land, the EC turns out be false. In such case, can the citizen sue the govt for issuing the false EC which has not reflected the fact that the title has not been alienable at the time of the registration of such alienation?
