Stamp duty

If one flat is sold for three times.

First owner had made agreement with builder before 1985 and not paid stamp duty.

2nd and 3rd purchaser paid stamp duty while doing agreement.

I would like to know that :

1) Is it necessary to pay stamp duty for 1st seller by last purchaser ( 3rd purchaser )?

If Yes Please clarify :

a) If last purchaser is ready to pay stamp duty but Original agreement of 1st seller is not available. What is to be done?

b) If last purchaser is not willing to pay stamp duty for 1st seller s agrement, what will be penalty to the last purchaser?
