Legal Question in Real Estate Law in India
We stay in occupied space last 40 years in Mumbai measuring 2100 sq.ft plot area,land is private and declared under slum.Builder had agreed term with landlord for re-development of property under SRA Scheme,their are 13 such houses where they have occupied large space measuring 800-2500 sq.ft,but they are legal tenants,and we are illegal tenants.Now builder had asked us to Vacant our plot and given us offer for 2 cr,but we are excepting 2.50 cr,now due to negotiation they are torturing us that they will surrender our property in SRA scheme if we don't agree for their offer,so my question is can they really have power to do this ?

You say you are an illegal occupant. But you are in possession for the last 40 years, so the builder cannot evict you without due process of law. It is better for you to negotiate with the builder and settle it amicably. You have very fair chances of success but in the process you have to spend money and time.
