i stay in a tenacy build.the build has been declared dilapidated by the BMC.but the landlord is not repairing the building. the tenants number around 7 are ready to repair the building, but the landlord is not giving permisssion.the building is in bandra west..thanks sameer..9867086799

You all tenant may serve the landlord with a legal notice asking him to repair the building giving reference of BMC and further giving him a few days time to start the repair. Your notice must also state that if the landlord fails to do the necessary repair with in time so given, you all tenants will collectively get the building repair at his cost.

Accordingly, once the period of notice is over, you all tenants may get the building repaired and recover the cost of repair from the landlord after adjusting the rent amount.

in case the landlord is not giving the permission to carry out repairs, you may move the court under specific provisions of Rent Act and seek directions of the court for getting the same repaired at the cost of landlord. but there may be a risk of eviction of all the tenants in case the building is shown to be beyond repair and unfit for human habitation.
