Subject : landlord tenant

tenant has lost eviction case in u p act no 13 of1972 under section from his landlord till high court.after that the shop in question has been declared as evacuee(custodian)poperty.thereafter landlord moved execution u/s 23 my question is.1.how tenantprotect his eviction despite declaration shop as evacuee landlord argue that he lost his ownership but he is still landlord and has right to evict tenant please write suggestion to tenant with caselaws refrences.
