Legal Question in Real Estate Law in India

Hi, Need your suggestion. My family consists of father(68 yrs), elder brother(42 yrs) and her wife, elder sister(38 yrs and married 16 yrs back), mother is no more. We own a bunglow which is in name of my father at my home town in Nasik, Maharashtra. My elder brother, his wife and my father currently stay in this bunglow and all the property taxes, water, electricity etc are paid from my father�s post office savings. Our relations are good and till now no discussion has happened on bunglow rights. My self I am 33 yrs old married and stay with my wife at self owned flat in Thane district. I bought this flat on my expenses and still paying loan. I wanted to know #1> how can I claim my rights on this bunglow as of now. What is the process? #2> what if my father doesn�t make the will and in his absence in future. Please suggest. Thanks in advance.

If meaning of words "we own" is that all are joint owners, then you can consider filing a suit for partition and separate possession.
