Legal Question in Real Estate Law in India

transfer fee co-op housing society

My father had bought a flat in 2002 in Vadodara(India). He died in July 2005.

In Feb 2009 I (his son) was issued a letter by the 'President of our housing co-op society' saying Transfer Fee for the said flat was not paid and I had to pay it. In Jun 2009 I was given another letter stating that the Transfer Fee is not paid and I must pay it or face consequences.

(I am not in possession of the transfer fee receipt, assuming my father has paid the fee.)

1) What is my legal position?

2) Am I legally bound to pay the transfer fee?

You are bound by the rules of the society.

Check bye-laws of the society. If payment of transfer fees is a condition precedent, you need to pay.
