Transfer of Flat

We have brought a resale flat in one of the chs, but according to the society. a person cannot transfer a flat twice in a year. As the flat belong to the peson expired during negotiation and the same flat was transfered in the name of his son. Immedieatly he sold the flat to us. Now when the transfer of flat has come to society, it is saying that according to the bye-laws, we have to wait for 1 year for transfer of flat.

Do any bye-law says so?

Just read the bye-laws and ask by quoting bye-law.

Transfer and transmission are two different modes.

Any society frames its laws and bye laws on an understanding and consent by and among all the members of it.You can frame whatever feasible laws you agree.BUt here in your case the transfer of property pertains to only one and the acquisition of the flat from father to son is not considered as a transfer as per your society bye laws I hope.
