Transfer of property
I have made an agreement to sale to buy a land in oct 2007. Agreement is on 100 rs non-judicial bond, not registered but signed by both parties. Value of land is 1,50,000/-. Earnest amount Rs. 1 lac has paid. Written possesion and receipt of earnest amount is mentioned in agreement. It was decided in agreement that after measurent the plot will be registered in favour of me. Now he is avoiding to registered and sending legal notice about not to registered & saying ' U can get ur ernest amount back'. I want this plot.. What should i do now? Please help.

YOU MAY file a civil suit seeking 'specific performance' of the contract in the local courts.

You need to file a civil suit for specific performance of your agreement and simultaneously seek an order against the owner to not to create any third party interest in the plot.

you have an option to file a suit for specific performance of contract. you may also obtain stay against the property and no third party interest can be created.
