rEGARDING TRANSFER OF PROPERTY

Hello Sir,

My father passed away recently in a road traffic accident . He has three non movable property . He has not written any ''WILL ''. Iwould like to know wheather the properties will be automaticaly transfered to my mother's name, if not what legal procedings should i opt to get it transferd. please advice.

Properties will come to all the heirs of your father according to the personal law by which I was governed.

If he was a Hindu, then properties would come to his widow, sons, daughters, legal heirs of predeceased sons & daughters.

Your mother is entitled to the property, the khata of the property can be transferred into her name, wherein she gets a valid title or hold on the property.

You are a co-sharer with your mother; the properties will be transferred in the joint name. You may approach the authorities for appropriate steps.
