Sir, I have a plont in up ghazibad which has been registerd in my name but stamp department logged a case of stamp theft against me" this plot is ragistered on origal cost and i have paid stamp duty on the same as pre current rate but they asked me to pay the stamp duty on the current circle rate rs.12000/- per sr mt that circle rate has been fixed by DM, Ghaziabad"
collector Ghaziabad has issued a RC against me for recovery and aquction this propety.
can a collector be auctioned this property for recovery of stamp duty less than the minimum circle rate of the area decleared by DM,Ghaziabd ? under the stamp act or any act of making the recovery from me.

Yes, the deficient amount of stamp duty can be recovered as 'arrears of land revenue' and your property can be auctioned for recovery. You better deposit the amount due and avoid complications.
Under stamp laws, collector are empowered to attached and auction properties for recovery of deficient stamp duty with penalty.
