Legal Question in Real Estate Law in
My uncle has taken a paper from my mother which states that she has given up all her rights to ancestrial property to him 30 years back. Now she wants to change. Can it be done ?

she has to send a notice of retraction and then file a case for getting the paper declared as null and void.

Yes, she can. The paper taken from her cannot be made a "relinquishment deed" for which registration is necessary. She should not make any further signatures on any papers; rather, she may inform the authorities that her rights should NOT be transferred to anyone without her consent by way of a REGISTERED DEED.
