Legal Question in Real Estate Law in India

Undivided share of land issue

Hello Everyone,

Thanks for this forum and I'm glad to have found it.

Here is the issue I would like some advise with.

1. Apt Developer sold apts starting 2006 to buyers with the development plan which included regular apts(Building A) and service apartments (building B)

2. In 2009 he has changed the idea of building service apts and is now building regular apt in a separate structure

3. In 2008 property was registered with BDA (Bangalore) with the original plan.

4. What is the undivided share each apt owner in Building A is entitled to ?

5. If building A residents pay property tax in 2009 as per original plan will building B owners have no undivided share ?

Please let me know if there are any other implications of this too apart from what I have mentioned

Re: Undivided share of land issue

Undivided share is specified in the Declaration of Condominium/Apartment.

Property tax of municipal corporation is generally levied on completed individual flats or entire building. If building B is not complete, then no tax.
