Legal Question in Real Estate Law in India

Unregistered partition deed

Hello we have a property in Orissa, wherein all brothers have entered into a partition deed. The partition deed is in writing but unregistered. Now we have approached the revenue official for changing of property into our names for paying taxes, but the revenue official is insisting on registration of the partition deed, kindly advise us with any judgment.

A "family settlement" is not required to be registered.

It may be difficult to persuade a local official. Therefore, you may better get the deed registered. It is not a complicated process.

Re: Unregistered partition deed

Not necessary to register, but if the revenue official is insisting, a writ petition can be filed against the revenue official.
