Unregistered partition deed
Hello sirs, I am in chennai. Myself, my sister and my mother (since deceased) went into a partition deed in 2002 and each have been enjoying the said portions of the divided portions of one of the properties. I have also taken a registered mortgage loan on my share of that property and cleared same. Now can I approach the registrar directly and get it registered in my name without getting the partition deed registered since my sister after my mother's death wants to take over the entire property.

A document can be registered within 4 months from date of its execution and for further period of 4 months by paying penalty. In your case, period of more than 8 months has already elapsed.
