Legal Question in Real Estate Law in India
unregistered society charging extra
sir, our's is a unregistered society, in which a resolution is passed in the AGM that that any member who wants to keep tenants has to deposit 15 days rent to the society for allowing the tenants to stay. This amount is charged against development fee. Is it legal ? what can be done on this issue?

Re: unregistered society charging extra
If Society is not registered, nobody is bound for anything. Since in case of unregistered Society, there are neither any members nor any committee nor any bye-laws etc.

A resolution passed by members of a society or even a group of people may be legal and binding. You may either leave the group / society or follow the decision.
