Legal Question in Real Estate Law in India
This is Venkat. I need a clarification on injunction order procedure.
We appealed to court for injunction order for my property when a person forcefully trying to enter my property. The court issued notice to other party. it is been already 9 months for since we appealed court. We are enjoying the same property from last 50 years and have all the legal documents.
Now he is not allowing us to do any activity in our property. For example when we want to take the yield from the land which we planted 5 years ego, he forcefully stopping us. When I approach the police with the relevant proofs, the police officer gave a judgement to get a letter from court to continue our regular activities since it is a CIVIL case.
As per my knowledge, I can continue to enjoy the property which we are enjoying from last 50 years since I approached the court to protect my property. The delay from other party should not effect our regular activities.
Please suggest me how can I approach the court for protecting us from our regular activities.

Apply for expeditious hearing.
you have a good case, ask your lawyer to oppose adjournment by the other party and press for hearing of the Injunction application
