Legal Question in Real Estate Law in India
can a wife of a deceased husband utilize pension, shares and fixed deposits at her will without the consent of her children? My mother has four sons and one elder daughter. I am the last son. My father died. He left some fixed deposits. He was the first holder of them and Second holder is my mother. Some of them have nominees of grandsons and sons. Nobody has taken care of mother except me. I am doing private job. I cannot maintain my family with my low salary. Our mother underwent both open heart and by-pass surgery. She needs money to her medicines and nourishment. The first two sons are greedy. They have forced my mother for fixed deposits in which their names written as nominees. The second son of my mother had already taken away the fixed deposit in which his name written as nominee. She is drawing pension of Rs.5000. But she has not received pension for the last five months, Can my mother cancel their fixed deposits and utilize the money without knowing of them? Shall I have to show the expenditure of the mother's pension to them? Please give your advise and suggestions to my questions.

Nominee names can be changed any time by the depositor.
You can also cancel the deposits after such nominee name change
