Legal Question in Real Estate Law in India

My wife expired 3 years back. She had nominated my father in law for her Postoffice accounts such as RD, FD etc. We have 3 yrs old son. My father in law has claimed all the money and didn't return to us being legal heirs. Initial days he said that he will invest in my son's name and hence I didn't bother about it. Even after 3 years, he neither returned this money nor invested any in my sons name. He declined to return now

can i claim that money now? can i file police case now? or it should be sorted via court case? if can i file case in my locality?

Nominee is merely a trustee for legal heirs.

In view of lapse of substantial time, initiate appropriate proceeding after consulting an experienced lawyer.
