Legal Question in Real Estate Law in India
My wife expired 3 years back. She had nominated my father in law for her Postoffice accounts such as RD, FD etc. We have 3 yrs old son. My father in law has claimed all the money and didn't return to us being legal heirs. Initial days he said that he will invest in my son's name and hence I didn't bother about it. Even after 3 years, he neither returned this money nor invested any in my sons name. He declined to return now
can i claim that money now? can i file police case now? or it should be sorted via court case? if can i file case in my locality?

I presume that your wife passed away at more or less the same time as the birth of your son. The first question that occurs to my mind is the reason behind your wife nominating her father in all her RD's and FD's and not you ? Was there a single nominee in all the RD's and FD's which fact can be ascertained by you from the local post office ? Your answers to these questions will give me some insight to guide you further in the matter.

Nominee does not mean the legal owner of FD or RD....
legal heirs have full right over the same..... you need to file a money suit in civil court... if you have any problem you can mail me at [email protected]
