If secretary is facing criminal case due to transfer of flats which is resolved in a.g.m. and comitee meeting who will pay the advocaate fees

Dear Sir / Madam,
Your query is not clear. If the concerned Co-operative Housing Society in the Managing Committee and the General Body Meeting has decided to pursue the matter in Court, the Society bears the advocate fees till the charges are proved, and the Secretary is convicted in the Co-operative Court. Thereafter, if charges against the Secretary are proved, the Society is entitled to recover its advocate's fees from the Secretary, unless otherwise directed by the Co-operative Court.
