In case of Sale in transit under Section 6(2) of CST Act, as a seller, shall we recoup the taxes & duties paid by the supplier in our invoice to our customer as Basic value + Excise duty recouped + CST recouped + Transport charges. Is is allowed under the above cited provision. What is the content of the case law - T.Stanes & Co Ltd V/s State of Tamilnadu & others as porter in 2005 (141) STEC 227 Supreme court case ?
