We use dissolved acetylene gas for welding purpose in connection with manufacgture of our final product. We have taken input tax credit for purchse of acetylene gas @ 13.5% Karnatka VAT during the year 2009-10. Now the departnment is restricting the input tax to the extent of 4% VAT only under Section 11(6) and disallowing 9.4% input tax. Kindly confirm that the department stand is correct and if not how we should defend our case ?
