Legal Question in Traffic Law in India
My Stationery car was rammed from behind by another car speeding on the road by loosing control and riding the foot path in the opposite direction and ramming my car. My car boot is heavily damaged. Both have valid insurance. I am a senior Citizen and my loss is heavy. How to get compensated for my agony, stress, travel to office each day by taxi, incidental expenses and repair expenses for no fault of mine.
The lone occupant of the car was driving rashly and is young working as Sr,Financial Analyst-Standard Chartered Bank, Nungambakkam. I do not want to collect my car until the perpetrator pays for the full repair as I had spent 30,000/- toward major service and sparingly using the car.
How can you help me and what should be my stand.
1 Answer from Attorneys
you should file an FIR against the person and should file case for damages in civil court. you need not to change your stand for anything. tell the truth and that is sufficient.
you should get insurance from the insurer upto major extent and remaining shall be given by the person.
