Legal Question in Wills and Trusts in India
I brought a 1 BHK falt in a society(OC yet to be acquired)mumbai few years back and had given on rent. Two years ago i decided to move in with my family so did renovation of complete flat. During renovation society commite did not allowed me to shift Kitchen in drawing room inorder to convert it in to 2BHK flat. But many other old flat owenrs having 1RK have convert in to IBHK by making kitchen in passage area and making bedroom in kitchen area. I have covered 8sqft area of balacony parapet inside falt for BETHAK(sitting area) during renovation and for this they are asking penalty of RS 10,000/- whereas they are not ready to impose any penalty on old members. Request you to kindly suggest what should be my stand and whether they can impose monetory penalty on me and to what amount.. Thankyou.

If Society made rules, after the earlier persons have modified there premises, they can impose fine on you. If what you are doing is against the Municipal law then also Society may be justified in imposing fine on you.
