Legal Question in Wills and Trusts in India
In case of Executor backing out and the first beneficiary apply for Transfer of disputed residential property as per the Registered Will , how the court will consider such cases ? Kindly clarify whether the court will issue Letter of Probate or Letter of Administration ?

Probate is issued when there is a Will and Letter of Administration when there is no Will.
