Legal Question in Wills and Trusts in India

Is it compulsory for a son to obtain probate of a witnessed will of a deceased widowed father even in the presense of a will and a valid nomination for an ownership flat in Mumbai? There is no claim of whatsoever from anybody since five years from the date of death. Son has one elder married sister. PL guide. Thanks in advance.
