Legal Question in Wills and Trusts in India

My father has a demat account in axis bank. there is no nominee on the account. he was deceased in 2011 in bus accident.

We approched a lawyer to succession certificate. He took death certificate(original), account summary paper and family member certificate( original) . He is telling he filed in court for certificate. He never took any signature on the application. He is telling he submitted original family member certificate in court.He never responds to any questions properly.

Is there something fishy in the lawyer.

Please let me know, can we file in court without applicant signature, is it required to submit original family member certificate.

No such documents are not required to be submitted in original... yes the lawyer has made something fishy of it...original are required at latter stage... and yes your signature are required on petition to be submitted... if he does not responce you immediately file a complain regarding him in Lawyer BAR association... and even report the matter in police and court...

Something is fishy for sure. Ask him the Case No. and make inquiries directly in the court. Or approach another lawyer and through another lawyer contact the old lawyer.
