Legal Question in Wills and Trusts in India
My father has a registered will foe a self acquired property which is 1/3 in my name and 2/3 in his. He remarried after the passing of my mother many years ago. What is the best way for him to ensure the property goes to me without any problems. Do the witnesses to the will have to be available for probate to happen?

If the will is signed by your step-mother as one of the witnesses, the dispute may not arise.

A will takes effect only after death. So it is better to draft and register a document that operates immediately and with minimum expense and full legal validity.
