Legal Question in Wills and Trusts in India

a gift was made from my father to one of his sons, this was made 35 years ago and was registered. it was promised that more land would be brought with this money and divided among the other brothers. this was not done, my brother brought more land but has put this in his sons name.

One of the witness is still alive who signed the gift deed, if i get him to sign a statement saying that the new land brought was to be shared, can i make a claim on the new land brought.

what else can i do.

If the promise was merely oral, it will not serve your purpose. But if the gift itself contains such clause then you can succeed. And one witness of the gift will certainly help you.
