Legal Question in Wills and Trusts in India

I`m from HUF family in west bengal.My father is engaged in gambling and take risk of ancestral house(property).Father don`t want to divide property, can i claim my right?

reply :-- But sir , In india westbengal & assam HUF property division or partical divison only possible after death of father, is it possible & if possible then where can i file?

one more doubt sir :-- but sir , in westbengal(india) , under "dayabhaga school of law" son can claim after death.

Even if you are not able to claim for partition, you will surely get an order of declaration that properties are ancestral or coparcenary properties with an injunction restraining your father from disposing of those properties.
