Legal Question in Wills and Trusts in India
I wish to inherit my uncle's flat in Mumbai.. My uncle & aunt have passed away & they don't have any son/daughter, nor they have left any will behind. Besides me there are two more nephews as legal heirs, but they don't wish to claim on the property. Both my cousins are ready to give me a NOC for the same. How should i proceed in this matter & what is to be mentioned in NOC to be received from my cousins ??

This will largely depend upon society's co-operation, they may insist affidavit, indemnity, NOC and sometime could insist Letter of Administration (Govt Order confirming there is no other heirs with process of giving public notice etc.). As flat is located in Mumbai; you need to file a Petition to Court, for Letter of Administration, without Will.
Contact a local lawyer, who can draft the Petition as well as affidavits of others who wish to give you NOC.
