Legal Question in Wills and Trusts in India
Mr. A, missed more than 7 year and his legal hair want to take the funds which is laying in his govt. department now my question is whether it is necessary to file a suit for declaration to presume death of Mr. A or directly file suit for succession certificate and then there is any problem. please advice me. thanks

yes, as more than 7 years have elapsed, he is presumed dead and a suti for succession may be filed.
