Order 7 Rule 11 of CPC 151
if the previous case is withdrawn without taking liberty from the court and without issuing notice to the objecter then can the new suit be continued ?

even though order 2 rule 2 would bar such a suit but a conclusive reply cannot be given unless both the suits viz. the withdrawn suit and the new suit are perused and their cause of action and memo of parties are thoroughly checked.
