Legal Question in Wills and Trusts in India

Power of attorney.

My father had made a power of attorney on my name in 2004. According to that power of attorney I could deal with all my fathers assets, both movable & immovable property.

We live in Mumbai but have 2 flats in Pune, both are on rent. Since 2004 I have been looking after all the property in Pune with the power of attorney.

Now my father is very ill & has to be hospitalized. Me and my father have decided to sell one property in Pune so as to bear the Hospital Bills.

I had been to Pune a few days ago & tried to sell the property, But the buyer's lawyer is asking for a Registered power of attorney.I fail to understand that till now this power of attorney worked & suddenly the need for a Registered power of attorney has arrived.

My father is in no state to come to the court to make a new Registered power of attorney.

Also in 2004 there was no need for a power of attorney to be registered.

I have a irrevocable power of attorney on my name.

please advice.

You may approach the registrar where the property is required to be registered. It is him who has to accept it not the lawyer
