Legal Question in Wills and Trusts in India

probate

Please inform rule no. and date of rule passed by the Supreme court of india rule which says that a will should be given for probate within a time period of 3 years from the date of death of the person whose will it is. If a will is given for probate in high court 5 years after the death of the drawer of the will, should the case be dismissed as per supreme court law?

There is no such rules which prescribes period of limitation for filing of probate application. Probate application can be filed any time after 7 days from the date of death of testator.
