Legal Question in Wills and Trusts in India

Property - Contest Will

My mother made a will and put 50% of the property (Flat + Estate) in the youngest son's name 25 % each in the Eldest & Second Son's name. She has excluded me eldest married daughter although I took care of her for all these years. Can I claim my share to the property? Agrieved Daughter

If the property was her 'own self acquired property', you may be deprived of any share; however, if the property in her hands was 'ancestral', your share cannot be denied.

Re: Property - Contest Will

You are not clear about the acquisition of the property by your mother.

1.If it is her own then you dprive from the right of claiming.

2.If it is your ancestral then you can challenge in the court.

Re: Property - Contest Will

if it was mother's self acquired property then she may dispose that off by will in favour of any one to the exclusion of the daughter. However if you doubt that Will then you may challenge it on the basis of your exclusion inspite of your close proximity with your mother.
